Chapter 8 Undermining the Pollution Issue

Twenty years have passed for the people who suffer the damages from the pollution of poisonous minerals from mining and the oppression from the Government, while resisting, appealing, and fighting day to day. Meanwhile, diseases, hungers and damaged yields of crop continuously threatening these people to the extent that they no longer can sustain their voices and rebellions as before.
To this situation, the Government says that this is the proof of end of pollution! It is very contrary to the fact that the victims of pollutions had been worn out from the pressures from the Government and the industry and can no longer raise their voices as before and down low in their spirits. Never the proof of any ending of pollution nor the recovery from extinctions which had been caused by the long standing years.
It has been twenty years since PM Tanaka first raised his voice on this issue of pollution from the mines at the Diet. Years had passed but to this day, the issue had never been solved nor the voices of people who're suffering had stopped since. However, the Government and the Industry together had been trying so hard to conceal their guilts and sins of years and oppressing the voices of victims so the world and the society do not realize nor know these plights and appeals that they can continue their ways of treating this issue as before with ease and light hearts. They now try to buy out the Yanaka Village, which is the center of the pollution and the place most affected by the damage for water reservors to prevent flood and to cover-up all the traces of damages and plights of people, which is the results of the guilts of the Government and the Industry, and the land under water, together with their sinful reputations.
However, the Yanaka Village is the most fertile area in the Kanto Plain. According to the elders of the village, the rice shoots do not need any fertilizers and you only have to weed once before the harvest in the fall, when the golden ears of rice ripen and fill the fields with good yields of 7 to 9 barrels( one barrel is about 18 litters by volume) per 1 are.  The villagers hesitate to move to other areas, knowing its fertility and longing for the past memories even when the pollutions and floods repeatedly and regularly attack the area. The Government and the Industry had been trying to chase out these people and deprive them of their lands, but no regular means would work to cut the bonds of these people to this lands. It was obvious from the very beginning.
So, look how harsh the means they took to chase people off the lands! The Government, who's supposed to protect the lives, properties, rights and freedom of the people, is the one who destroyed the banks, which is almost equal to the farmers life-lines. They threatened, intimidated and pressured the people to go out of the lands, as if some gangsters would do. Who sent these guys who nailed the watergates at the time of floods and let the polluted water fill all the areas and set the pollutants to silt. Who stealed the villagers' fishing gears when they were suffering from poor crops and going hungry, depriviing of them the other measures of sustaining their lives. Who blindfolded the honest and straight young men with gilds and lurred them with rice wines and women, that they were bought out. Who did, indeed? Who started all these? The Industry! And they say that it was the Yanaka Villagers themselves who destroyed the village, PM Tanaka and the Social Party. How shameless they are! The cold-blooded brutes, they are! Your name is the Japanese Government!
The guilts and sins of the Government, who engaged all the possible measures to damage the ignorant and powerless peasants, should be recorded and remembered. And people of the Yanaka Village would, as long as they live inthe area, renew their memories of "Pollution" everytime floods and overflows take places. So the Government had not allowed to rebuild the banks of Yanaka Village since Meiji 35 and let the people suffer, so that they can negotiate them to leave the damaged area to be free from the sufferings and in the end, they declared that the village is no longer sustainable with such a little population left and forcifuly merged the village with Fujioka Town. And on June 29th, this year, the Government enforced the Compulsory Purchase of Lands Act to forcifully buy out the lands and destroyed the village to none. Coming springs and falls, with winds and rains, the floods will flow freely into the fields from the broken banks, but it never matter for the Government. The destruction of Yanaka Village is not only the destruction of a village, but it is the destruction of the pollution issues, which had been the issues for long. It means the victory of the Industry centered and controlled politics which pay no attention to the public interests and benefit from the bloods and bones of the people. Such is the luck of the people, the poor and the weak born in Meiji Era.
16 some years had passed since the issue of pollution first brought to the Diet. Mutsu Munemitu is now dead and so is Furukawa Ichibee, also the adopted successor to Ichibee, who is the second son of Mutsu is deas. The plan to bury the polluted lands by Minister Mutsu, after their death, is now enforced and accomplished by Minister of Interior Hara Takashi, who is the employee of Furukawa, economically, and henchman of Mutsu. Is this not some kind of story, isn't it? I am now going to tell the history of the construction of the water resoivors, which is the problem today facing the destruction of the Yanaka Village.

At the same time, PM Tanaka Shouzou exit the Kensei Hontou, his political party, wishing that this pollution issue would not be put on the political agenda of the party and also resigned his job as PM. After this, he started his campaign to raise the voices to appeal the pollution issue simply as his personal endeavor and belief, which last to the end of his fight.
It was at that time he heard of the arresting and victimization of the people who rose to appeal the issue to the central government. How cruel the people! There were nobody who'd listen to his appeal, no one to care about what he is talking about and the general public just ridicules, slanders and persecutes his deeds. He was already put down personally himself and this news added to his indignation. He was red with tears of sympathy or was it his boiling blood of anger? It is no doubt that his had made his mind to appeal directly to the Emperor at this moment.
Next year, Meiji 24 in December, the first year of 20th Century was coming to its end, with two more weeks to go, 16th Diet was called for and the Emperor was on his way to attend the opening ceremony of the Diet on his carrier. When the carrier approached Hibiya Field, suddenly somebody dared to approach the holy coach. With purple glitters, white edge of swords shine all at once and the cavalry was ready for action. There was a big voice calling for the Emperor to listen, "I pledge!" Who else would be this man? It was Tanaka Shouzou, the most faithful hero of justice, already caught by the police, before the Emperor even heard nor noticed.
What a pitty! In the history, a faithful community man of Sakura who appeal the predicament to the Shougun was crucified. Today, the Constitution is settled and still this man appeals to the holly coach of the Emperor at Hibiya Field. This was such a historical event in the history of the Emperor reign. Dark! Dark! This should not be so in any civilization. But you'd understand why he had to do so. This old man thought of all measures which could be taken would be no effects in the end and had to choose this direct action to appeal with his life for the pitty of these 300,000 people. Here, I have the copy of his letter to share with you, I am sure anybody who read this would be so moved and could not help to burst into tears.

Humble Appeal to the Emperor

As a royal nationalist, who seeks no fame but ready to serve the nation when in need, your humble servant Tanaka Shouzou am very sorry and feel very much obliged to lower my head and lower myself to appeal to your Majesty, which is indeed an act of unlawful and immoral and approaching your Majesty's Holly Coach truly deserves to death penalty of this country. But never the less, the reason why I should take such a shameful act, is for the sake of the nation and its people from the bottom of my heart. I could not bear to oversee the plights of these people to the extent to turn to such a deed, so please, your Majesty, with your mercy, tolerance and understanding, and pity me, your humble servant and take note of what I should say.
There, about 40 Ri(60kilometer) North of Tokyo, is Asio Copper Mine, (snip), the polluted water and slag, which are generated when they mine and refine copper ore, fill all the valleis and run into the Watarase River and there is nobody along the river banks who escape this damage. The damages had been escalated as the industry flourish and increase in the volume of poisonous pollutants, also clear cut the forests and bare the surface red soil at the source of the river, which led to more often floods and spreading the poisonous flows cover all directions. Affected areas involve Ibaragi, Tochigi, Gumma, Saitama, all four prefectures and the downwards amount up to some hundreds of thousands hectares and fish catches vanished and people lost their income source and jobs. Which leads to hunger and sickness, but because of the loss of income, they cannot get the necessary medicine and young and old are left in the pits and vallies and those who are able to work seek outside for jobs and moved away. Once were fertile and productive feilds twenty year's ago are now covered with rush and reed.
I, humble servant of your Majesty, cannot stop listing all these predicaments of the people, which is at the peak, and cannot stop worrying and pittying and when I was elected as one of the Diet member, at the Second School, I raised the question to the Government and after that raised the same question ever since, over ten years, now. But the Government did not anwer to my questions nor their request sincerely. Even the local officers did nothing and more than that when people rose on their feet to appeal their case, the police oppressed their action, called them names and arrested them. Now, the revenue of these local governments had declined by 100 of thsands yen, that their autonomies had failed to function fully, and that hunger, deseases, death from the poisons prevailed the area.
Your Majesty is devoted with talents and virtues, which is next to nobody, your virtuous gifts fill four oceans and reaches all eight universes and biliions of people all enjoy raised level of life everywhere. Not far away from your Imperial capital, hundreds of thousands of innocent people pitified and wish your mercy even for a drop of water crying out. Is this not your shame? It is the fault of the Government officers who underestimate your cleverness and the local officials who do not pay attention to the lives of your people at all. Are all these four prefectures your family members, are they not? Are all these four prefectures people not your babies? The officers of the Government caused and overlooked these plights of your people and lands, did they not? Please, I ask your Majesty to make your officers work for your baby so that they can be adorned with your Sun and Moon's benefits. The only way is to purify the water of Watarase, second is to rebuild the river banks, number three is to remove the poisonous soils, number four is to recover the natural resources of the estuary, number five is to rebuild the villages and towns along the river, number six is to stop the polluted water and slags totally. With these measures, the country can save hundreds of thousands people's lives and prevent the loss of population in the area and show that the Constitution and the laws are valid and effective in this country to protect the rights of the people and wealth and to prevent the loss of national power which is the base for the nation. If you'd failed to do these and let the poisonous water run as it does, I am afraid the damage will be far reaching to the extent you'd never be able to imagine.
I am 61 years old and am diseased with not much days left to live, still I wish that my efforts bear fruits one out of tens of thousandth chance to let you hear, not judging the benefits and loss of my life alone, of this urgent matters, with tears and sorrows. I bow to hope your Majesty's clever and wide wisdoms to bestow over this issues. If heard, my pitiful calls will meet its responsibility.

At first, PM Tanaka expected execution if he'd dared to directly appeal, so he divorced his wife, Katsuko, sending a letter of parting, and met their daughter, who'd married already to tell her of what about for future. For 300,000 lives he had fought for more than ten years and yet the society nor the Government did not hear what he had to say. While the predicaments developed and the poverty prevailed over his hometown. Out of worry and out of sorrow and anger, his heart was almost broken, when he heard of his people's plights, failure to forcifully appeal to the Government.
So the situation today is that he will die if he'd proceed and he will also die if he withdraw. He had made up his mind to take death and dared his life for appealing to the holly Emperor, and this was really his last resorts. The Government officers, who's leisured their jobs and invited this situation developed to this extent, were surprised and lost their minds to how to deal with this, just resolved to call Old Tanaka a crazy man and settled the situation. What a sly measure the Government took and one can only laugh at this development but is so disgusting to see how shameless they are!

Chapter 6 Gang of ruffians incidents took place

Sept. 17th, Meiji 31, there was a flood as harsh as that of 29th. The water overflew the bank, which was 5 meters high, and reached almost 7 meters high. The riversides along the Watarase River were turned into a wide ocean of poisonous water and people of Kawabe Village, Satama Pref. were evacuated by Takasebune Vessels, 36 tons in size, to the high land north to Suzumenomiya, Koga Town, Ibaragi Pref.. The pity of the victims were as such and their wretched conditions accumulated day after day. You can look at the data from this year. Compared to the national average, two died out of 8, whereas the poisoned area accounted to 6 out of 8 are dead. The two alive also were affected by the poisoned water and foods and will eventually die from poison. Look at the houses which roof were wretched and walls down by wind and rain. People who lost their pillows for good night sleep were time and again affected by the poisonous rush of waves which over flow the banks and fill the whole area once a heavy rain hits the area. If you don't call this a pity of life, what would?
Ichibee Furukawa, on the other hand, live in a big mansion alone and gained huge sum of income, spending luxuriously over women and spirits as if he have no knowledge of the pity of vast areas far away from his factory, as far as some 40 50 kilometers! And he does not have ears to hear the claims by the victims who're crying over the loss, freezing and starving, not knowing where to turn to, and that's the same for the officers in the area. Even the plights of people nwhich PM Tanaka Shouzou outragedly put on table at the Diet and people reported by themselves, these made no effects to them. How arrogant they are! They are as foolish as partying on top of an active volcano, which is about to explode!
Look! Finally people exploded with rage. Listen, in the evening of Feb. 12, Meiji 33, the sound of hanging big gong-bell of Unryu Temple, the working center for anti pollution, located in Sagawada, Watarase Village, Oura County, Gumma Pref., broke out carrying the message over the winter weathered land to far. Hearing it, there gathered 3,000 people, wrapped up well in thatched rain gears from Tatara, Watarase, Oosima, Nishiyata, Ebise, Satoya, OOgano in Gumma, Keno, Agatuma, Kuno in Tochigi and Yanaka Village, started to march to gather singing the songs which illustrate the pity of pollution, saying "The poison penetrate into the body, the pregnant mother miscarry, the babies born suffer from poor breast feeding, even after their 2 or 3 year-old birthday, they fell to deseases, being their body weaken from poison. ... There is more stories to tell without end....." This action was planned in the previous year, because all their claims had been neglected and being insulted and abused which were intolerable anymore that all the 34 villages and 1614 communities together raise to appeal directly to the Minister of Interior and if not heard, take it to emergent actions.
Prior to this, the Gumma and Tochigi Prefectural Polices opened a headquarter in Tatebayasi and in Sano, respectively and mobilized several hundred of riot policemen to be prepared against any emergency and guarded the riverside at every crossings of Watarase River with dozens of policemen stationed.
On 13th, at 10 in the morning, when the march started, the number of people gathered wes swellen as many as 12000. The village mayor of Kuno Village , Inamura Yoichi, led the demonstration and Noguchi Shunzou, Vice Mayor of Sakai Village , led a troop of youth, riding a horse giving commands, raided the Oura County Office. The County Mayor fled with hear so there is no way to appeal to, so they went on to Tatebayasi Police Headquarter where they opened a fight with policemen and 5 people being injured. The damage did not silence the demonstrators, but they vigorously fought against the police and broke the guards and proceeded as far as to Kawamata. There were the main force of police and also hundreds of riot police at guard, so Noguchi Shunzou and his youth group of 2500 men carried two vessels on trollies, with sharpened bamboo shoots, which work like sword, proceeded towards the police barricades. To this forceful march, the riot police fought with swords, kicked with their hard boots and bet with their fists, threw sand and mud, arrested the fallen and injured. Some ten injured, and the vigilant started to withdraw.
The Head of Tatebayasi Police marcylessly chased after the demonstrators, shouted, bet, knocked down, stepped on, beaten by the cover of their swords. One of the old men was thrown into the water by 5 policemen, one was put mud to his eyes and his mouth, the injured left at the roadsides laid and blood everywhere for some miles. It was almost like a fighting battle field!
So much efforts by the victims, with much planning and struggle, were prevented by the police and ended in vein. Look how the police oppressed the people, raided them like thunder striken, arrested Inamura Yoichi, Murota Chusichi, Sitara Jyouhachi, from Kuno Village, Noguchi Shunzou, Sakai Village, Yatu Tomijirou, Yanaka Village, Kamei Tomoji, Tatara Village, all suited as violent riots and sent to Maebasi Local Cout.
Violent riots! What a name they labeled after so much energy, blood and tears of months before! They rose simply to protect their rights and livelihoods and to appeal their predicaments, supporting each other to proceed with their old and sickened people, to proceed towards Tokyo. To these people, the Government name riots, villains and mobs. You seek for bread, but were given stones. How many times you'd appeal, you are not heard and when you resumed to your last physical means, it also failed. How much the people arrested worried about their sicken families left back home, recollecting the pities of their homelands, weathered by pollution, and felt the cold- bloodedness of this society and crueltyand brutality of officers of this country from the bottom of their hearts inside the coldness of the jails, left in the darkness merely lighted by the moon outside of the windows.

Chapter 5 The Forth Period of Development of Pollution

Meanwhile, in Meiji 29, there were three big floods, July 1st, Aug. 17th and Sept. 8th. The level of water surface raised over 7 meters high and the people living on the Watarase River banks were floating in the poisonous waves which carried toxic silt of nearly 1 meter thick, unabling the patty fields to yeild, poisoned people and animals. You can never imagine how bad it was. The toxic water from the Watarase River flew through Tone River to Edo River which runs into Honjo, Fukagawa in Tokyo. The flood came up to the house of the Agriculture Minister Enomoto, in Koume, Fukagawa.
Next year, Feb. Meiji 30, PM Tanaka questioned the Government by letter. To this, Minister General and Agriculture Minister answered, but this letter revealed that the Government is trying to protect the industry and silence the people, thereby ignore the pollution issue. Here is what it says.
"The pollution of Asio Copper Mine, Kamituga County, Gumma Pref had been thouroughly inspected several times since Meiji 23 and it is acknowledged that the land along the Watarase River contains pollutants. And by Meiji 25, the miner accepted arbitration between the representatives of estuary victims and concluded contracts and agreed to pay compensation money and from July, Meiji 26 till June Meiji 29, because the pollution prevention machinery is still at the experimental stage, the contract acknowledged that contractees should make no complaints, nor take any legal nor municipal claims at all. "
Also the letter said, "The people of Watarase Village and other villages had agreed to the contract of July, Meiji 25 with the miner and had concluded accordingly out of court, therefore the Government does not hold power deal with the matter."
The Government discard its responsibility and moreover says as follows: "Moreover the damages done to the commons of these villages is covered by the Item 5 of this contract and leave rooms for future opportunity for consultation, therefore the matter should be brought to the civil law."
The Item 5 refereed in this paper is the settled contract above. So, it is clear to me that this contract shows that the Government wanted to disregard the pollution issues from the political debate at all and to leave all to the civil law.
The Government surely has no sincere will to supervise the miner and prevent the pollution, rather deceive the people that these machinaries is for the protection of the people themselves. Who would be deceived by such! The victims who read this paper were so outraged that on 23rd demonstrated toward Tokyo in big number and wished to reveal the situation to the Governemnt, but unluckyly stopped by violent police. But the Government was so surprised and frightened that they set a committee to study the pollution situation and also ordered tax exemption to the damaged area on 24th.
The setting of a study committee and the tax exemption were the result of such urgent actions. If not for the ruthless actions by the victims, I believe, that such temporarily cosmetic measures still would not have been realized. The Cabinet of the time was based on the unit of Count Okuma and Count Matukata, who were politicians representing the civil side, who happened to be in power, which was very lucky for the victims. If not, and the Governement being as was, these desperate actions would have ended in threatening the people with swords and arresting under the suspects of violent upheavals by the police and riot police.
On May 27th, Meiji 30, the order for pollution prevention was first issued. I don't have time to go through this order in detail right now, but I am sure that the pollution prevention law had have not worked at all to lessen the damage that we have seen that the fishermen, over 2000 operating had decreased to one tenth, with all the catches of Ayu, Salmon, Trouts, which are famous products of Watarase River had gone, with a little catch of "Haya" being left, and when the river water taken into the patty fields the sprouts at the mouth of water intake was severely hampered for their growth and when you burn the straws there were polluted minerals left in their ashes. These are the evidence you could never doubt.
Moreover, there were three types of tax exemption.
1. To the field to which the water from Watarase River is taken
2. To the field to which the overflow from the Watarase River upsteam is taken
3. To the field which flooded in Meiji 29
There were slight difference in the degree and length of tax exemption according to these different conditions. When you say "victims", there should be some recognition of the harsh damage to light damage. But the Government made a huge mistake of looking at the light damage area, where the farmers easily agree to the small tax exemption, not seeing the bigger damages experienced elsewhere.
Therefore, look! The Venue lost 300,000yen annually, but the loss of the people were much bigger. You can recognize the loss by way of decrease of number of voters in this area. I will list the comparison.

What you can guess from here is the loss of local autonomy. These local governments which had lost their residents radically had seen the degrading of their funcitons, to the extent that these villages being lost forever, namely Oshima Village, Gumma Pref., Kuno Village and Yanaka Village, Tochigi Pref..
The Tax exemption simply worked as isolation measures of the victims. In the result, the measures curtailed the rights of the nation and broke the local autonomy. Nobody, no men nor women, tens of thousands of them, benefited from these measures, who are left with the fields which turned into vast barren lands, lost jobs and products, nowhere to turn their claims against, crying out looking up to the sky vainly.

現代語訳は無しですが、この章では、被害民と古河の契約や念書がいくつか例が挙げられている他、鉱害の本当の理由が、鉱山による恣意的な鉱滓放流にあることを証言した原稿が紹介されています。

あまりにも今の福島第一原発事故との類似性の高さに、日本政府の民度の低さ、企業姿勢の変わりなさを思い知ります。

Let us look back how things went, I would say the followings are so obvious. The officers of Meiji Government never considered people’s benefits nor happiness, and overlook the plights along the Watarase River, as if it is a thin cloud in the sky or mist, and sabotaged their services and moved to protect the private’s benefits of miners, instead.
However, the cause of the plights along the Watarase River has been proven to be the Copper Mine of Asio, and the cries of people living there are rising ever louder and louder until it attracted the public attention, as big as the Government could not ignore. But see what the Government did was to oppress the voices of the victims and make sure that they would never raise the issues again.
Look! Ichibee Furukawa proposed to settle the issue out of court with the victims. Who mediated? It was the Governor, the head of the villages and the offices, from the top to the bottom. On March 20th, Meiji 25, they chose members of Arbitrary Board and after some negotiation, on June 15th, it was conclude to pay 40,000 yen to Aso County, Harita County and Shimotuga County, and on July 28th, they promised to pay 30,000 yen to Harita and Asikaga by 3 year loan.
Meanwhile, in Gumma Prefecture, the Governor Nakamura asked Council Nomura to mediate Watarase, Oosima, Niyata, Ebise Villages, when these peasants forcefully came to Tokyo in June and conclude to compensate 15600 yen from Furukawa to these villages and what’s more to pay for the cost of Samurai and Yaba Banks’ pollution dredging, under the name of donation of 6500 yen and successfully concluded the mediation.

What an atrocity by the local officers!  They never knew anything about the plights of the majority of peasants and took efforts of settling out of courts for the benefits of the Miners and pressed innocent people with their authority to agree to these mediation proposals. We should remember, moreover, that these acts of local officers are not by their own ideas nor from their personal initiatives, but by the secret order from the Central Government. This is why I call these acts as systematic conspiracy by the Government and the industry to diminish the Yanaka Village and there is no way to refute against these sins and guilt of the Government.
Just see the contracted papers! You can see clearly these papers works to protect the benefits of the industry and with little money to shut-up the voices of the victims.

The Contract

Regarding the powdered minerals flew out from the Copper Mines, located Asio, Kamituga County, Shimotuke-kuni, owned by Ichibee Furukawa, which caused damages along the Waterase River, a mediator was selected and concluded the mediation between the 12 members who had been delegated through legitimate procedure and Ichibee Furukawa, after through deliberation, as follows.
Article 1 Ichibee Furukawa will build sophisticated dust collectors at the Asio Copper Mine by June 30th, Meiji 26, in order to prevent the flow-out of powdered minerals.
Article 2 Ichibee Furukawa will entrust to the mediator the settled compensation money out of court as follows:
Item 1 Pay 319.619 yen to the lost benefits regarding this mediateon.
Item 2 Pay 5000yen allotted to Kuno Village
Item 3 Pay 2200yen to prevent flooding, half in Oct. 30th, Meiji 26 and other half in April 30th, Meiji 27.
Item 4 Item 1 & 2 should be paid immediately.
Item 5 IItem 3’s payment should be made to villages concerned, if the planed construction could not be completed due to unavoidable conditions.
Article 3 After Ichibee Furukawa made the above payments, until July 30th, Meiji 29, it should be acknowledged as experimental period for the dust collector’s operation, hence there should be no complaints nor any other administrative nor legal arguments made.
Article 4 If we see the effects of the dust collector being satisfactory by July 30th, Maiji 29, this contract will conclude for good and final and urge both sides to reconcile.

Article 5 If the dust collector will fail, starting from July, Meiji 29, further consultation should be opened and new contracts made.
Article 6 Ichibee Furukawa, may cut down trees on the mountains at the headwaters of Watarase River, should try not to damage the water sources and replant seedlings on the cutting grounds.
Article 7 Those who’s sell the land concerned, should inform the buyers or the receivers of this contract and proceed the process. It is the same for Ichibee Furukawa. If this procedure had not been taken, the buyers nor the receivers will not be able to make any claims against Ichibee Furukawa and the contractees should take responsibility of conflict settlement.

Article 9 This contract will be made two copies and shared. After the conclusion of this contract out of court, reconciliation between the parties should be agreed and no future objection be made, thereby signed.

Regarding the erosion of pollutant minerals and soils from the mines owned by Ichibee Furukawa at Asio, Kamituga County, Shimotuke-no-kuni, there has been damages made to the towns and villages along the Watarase River banks. On the other year, we, the victims of the pollution from the Mikuriya, Tsukuba, Hasida, Yamanobe, Hajika Villages and Ichibee Furukawa, under an arbitrator, settled agreements out of court as follows and today the contract had come to expire, so hereby we, the 28 representatives selected from Mikuriya, Tsukuba, Yamanobe, Hasida and Hajika Villages through legitimate procedure, and Ichibee Furukawa agreed to the contract as follows after thorough deliberateon:
Article 1: Ichibee Furukawa will pay the settlement money as follows:
Item 1 600 yen, for the settlement until the December, Meiji 30th.
Item 2 350 yen, for the annual payment on April 25th, from Meiji 31st on.
Item 3 As long as Ichibee Furukawa pays the settlement money as above, the people living in the covered area should make no pledge to the Diet nor raise suit in the courts, nor make no further claims regarding this matter at all and never in the future.

Item 5 When Ichibee Furukawa ends the operation of the Copper Mines or succeeded in preventing the pollution erosion completely and no damges are acknowledged at the Watarase River banks publicly, this contract will expire and lose its effect at all.

I, first read this contract, found there are some misunderstanding of facts, on which the agreements are made. Look, these contracts only mention eroded minerals from the mines as the cause of polluteon. Therefore, the contracts are concluded on the assumption that the mineral collectors are the only means for damage control for the pollutions. However, I have come to know that the pollutants are not only the eroded minerals from an article written by a worker at the Asio Copper Mine, to the No.232 of “Rokugou”, publicshed on April 15th, Meiji 33. It says:

I will now write about the causes of pollutions, but before that, I should mention that the pollutions are not natural disaster and if not by the hands of people, these pollutants will never erode and damage the environment of rivers downwards. Nor it is caused by some flooding at the time of heavy rains occasions. There is more severe cause of damage as I am going to state now.
To start out with, the Asio Copper Mines was developed by Yokoma Buhi who fond a quality deposits and succeeded in the businesss to the extent that the sledges from the selections contained 6% of copper still, but was discarded by heaps in the area. The main entrance for the mining tunnel was filled with this sledge from down below the housing of workers on for 30 meters, which became almost rocky through weathering. By and by, these rocky sledges covered the valley and they became short of the discarding area and started carrying them by rail to the next valley or used the roads, all day all night by the 25 people’s work with trucks which can carry 16 sai (translater don’t know this unit). Ariki Entarnce carried out 495 truck a day, with 16 sai per truck and filled one valley so quickly expanded the rail to the next valley and fill it by Meiji 29, a hollow by the size of 330 meters long, 100 meters wide, 20 meter deep, called Kyoukonai. They extended the rail by 760 meters to Koubaraki. These expansions in search of discard area, pushed the cost up. For example, from the mine to Kyoukonai, one truck full of 16 sai will cost 5 sen and 500 truck per day will be 25 yen. But if you’d carry that to Koubaraki, the cost per truck will be 12 sen, which will increase the cost by 35 yen per day which by year will add up tp 12700 yen and added to that the cost of maintenance for this railroad through harsh hillside 1000 yen per year, at least. Therefore, the miners wanted the distance for discarding to minimum, washed off the sledges deliberately at rainy days. The sledges have the tendency to concretize became solid at the river beds and was not easily washed away by heavy rain. For example, the land for Honguchi Housing area is 30 meters high by this sldge, but you should never be afraid of landslides at all and these houses are build on top. If you want to destroy it, you’d have to use explosives. Therefore, once there should be an occasion of heavy rain, day or night, an emergency call will be made to the workers to come and break the sledge by explosives and levers to throw into the Watarase River.
As it being said, the bulk of sledge wich contains 6% mineral constantly carried out from the mines will fill up the valleys and waiting for the rains to come to wash down the river. This is the real cause of pollution which public do not know.
The floods invite pollution, that is no doubt. I will now show examples of length of damages.
At the time of Aug. Meiji 23, Honguchi and Kyoukonai’s sledges were broken and discarded with more than 100 workers’ labour, day and night. Until July 29th, Meiji 29, there had been no heavy rain, so the accumulation of the sledges were heaping up and plan to expand the rail to Koubaragi became realistic. On July 21st, they managed to throw down some of it, but with the rain of Aug. 17th, they used more manpowers and explosives to break from the bottom of the heaps. On the same year Sept. 8th, they succeeded to break 100 meters by 30 meters, 20 meters deep deposits into pieces to throw away. When you think of the years and the damages to the crops, we should know better.
(omission) Even if a harsh order to end the pollution, it was not easy to see to the effect. If I mention some dirty hands of the miners, Oct. 12, Meiji 26, when Yamada Taizo came for suspection, the mine manager ordered the mayor of Asio to brocade all the inns and temples, theaters which could be used for their gathering and send strong men to block his passage on the road. Also, against the group of Arai, Tamura, Noguchi and Takahasi, they welcomed with sweets word, bowed and entertained with gorgeous dished and partied, to blur their suspicious eyes. Whoever comes from anywhere for the inspections of the mines, immediate calls are made from the central office to the offices of all ends to cover-up and hide whatever seem suspicions for the pollution and stop operation, you’d see no running sewages from the mines at all. How can you prove the damages by such decisive Copper mines?
The cause for the pollution has not been investing, yet. And the erosion had been cased humanly, it is Furukawa who is responsible for the devastated 50,000 hectares and 300,000 lives.

You see the evils by the copper mini owner as such and how decisive they are! They’d stated that the real cause of the damage is by the polluted mineral and pay little money to shut the people’s mouth. One should not hate such deeds for the sake of it treacherousnesss. And the Government, who innocently took the responsibility of arbitration, they should be held responsible, too. The guilt of ignorance should not be overlooked. And if they knew and did what they did, the sin of defrauding people by the Government is so big and so clear. Such is the plights of the ignorant majority of victims. They, either trusted the Government, threatened by the officials, or lured with the little money before them, came to agree to receive such little money to shut-up forever against the damages by the pollution and accept to endure the damages year by year with a little compensation.

Let us look back how things went, I would say the followings are so obivious. The officers of Meiji Government never considered people’s benefits nor happiness, and overlook the plights along the Watarase River, as if it is a thin cloud in the sky or mist, and sabotaged their services and moved to protect the private’s benefits of miners, instead.

However, the cause of the plights along the Watarase River has been proven to be the Copper Mine of Asio, and the cries of people living there are rising ever louder and louder until it attracted the public attention, as big as the Government could not ignore. But see what the Government did was to oppress the voices of the victims and make sure that they would never raise the issues again.

Look! Ichibee Furukawa proposed to settle the issue out of court with the victims. Who mediated? It was the Governer, the head of the villages and the offices, from the top to the bottom. On March 20th, Meiji 25, they choosed members of Arbitrary Board and after some negotiation, on June 15th, it was conclude to pay 40,000 yen to Aso County, Harita County and Shimotuga County, and on July 28th, they promised to pay 30,000 yen to Harita and Asikaga by 3 year loan.

Meanwhile, in Gumma Prefecture, the Governer Nakamura asked Council Nomura to mediate Watarase, OOsima,niyata, Ebise Villeges, when these peasants forcefully came to Tokyo in June and conclude to compensate 15600 yen from Furukawa to these villeges and what’s more to pay for the cost of Samurai and Yaba Banks’ pollution dredgeing, under the name of donation of 6500 yen and succefully concluded the mediation.


What an atrocity by the local officers!  They never knew anything about the plights of the majority of peasants and took efforts of settling out of courts for the benefits of the Miners and pressed innocent people with their authority to agree to these mediation proposals. We should remember, moreover, that these acts of local officers are not by their own ideas nor from their personal initiatives, but by the secret order from the Central Government. This is why I call these acts as systematic conspiracy by the Government and the industry to diminish the Yanaka Villege and there is no way to refute against these sins and guilts of the Governemnt.

Just see the contracted papers! You can see clearly these papers works to protect the benefits of the industry and with littlee money to shut-up the voices of the victims.


The Contract


Regarding the powdered minerals flew out from the Copper Mines, located Asio, Kamituga County, Shimotuke-kuni, owned by Ichibee Furukawa, which caused damages along the Waterase River, a mediator was selected and concluded the mediation between the 12 members who had been delegated through legitimate procedure and Ichibee Furukawa, after through deliberation, as follows.

Article 1 Ichibee Furukawa will build sophisticated dust collectors at the Asio Copper Mine by June 30th, Meiji 26, in order to prevent the flow-out of powdered minerals.

Article 2 Ichibee Furukawa will entrust to the mediator the settled compensation money out of court as follows:

Item 1 Pay 319.619 yen to the lost benefits regarding this mediateon.

Item 2 Pay 5000yen allotted to Kuno Villege

Item 3 Pay 2200yen to prevent flooding, half in Oct. 30th, Meiji 26 and other half in April 30th, Meiji 27.

Item 4 Item 1 & 2 should be paid immediately.

Item 5 IItem 3’s payment should be made to villeges concerned, if the planed construction could not be completed due to unavoidable conditions.

彼らに「逃げていい」「臆病者とは言わない」「卑怯者とは言わない」誰もが逃げ出した時に、制御不可能なものを作り出すべきではない。「人間の安全保障」という概念はものごとの考え方を180度変えた。国家の安全保障ではなく。「ノーを言う権利」【上野千鶴子】卑怯者とも臆病者とも呼ばれない。
非常時に「決死隊」。70年代の学生運動のがれきの中からフェミニズムは、「非常時のヒロイズムはいらない」と言うため。日常の暮らしの場をたたかいの場に変える。「女も男並みに強者になろう」ではなく、女はケアを抱えたとたんに弱者になる。その責任から逃げなかった。その責任がないかのごとく
責任から逃れて、平等をいう強者。「弱者が弱者のまま、尊重される」そんなことを。ピークにたった人も、弱者を経験する「超高齢化社会」。時間と年齢は誰にも平等に訪れる。【上野千鶴子】弱者になるまいとするよりは、誰もが安心して弱者になれる努力をした方がいい。

白熱教室 JAPAN in ヒロシマ

広島出身の川本隆史さん(東京大学大学院教授)が、一般公募の人々も含めた500人を対象に、広島大学で行ったもの。第一回は「ロールズの「正しい戦争のための6つのルール」。

1995年に発表された「ヒロシマから50年」で、ロールズは太平洋戦争において米国が日本に原爆を投下したことを批判する。その批判の根拠として、ロールズは「正しい戦争の6つのルール」をあげる。Just War

白熱教室は、この6つの原理を大きく前面に映写しつつ、それに対するそれぞれの意見の交換という形で進められた。

ロールズの論文はまだ確認していないが、川本氏による紹介は以下である。

1.その戦争の目標が平和構築のためのものであること。
2.まっとうな民主社会は、非民主的な国家とだけ戦争する。
3.戦争の責任は、次の三つの集団ごとに、その戦争責任の軽重の判断が異なる。1 指導者、2 兵士、3 非戦闘員
4.相手国の非戦闘員と兵士の双方の人権を尊重する。ex. 捕虜の扱い規定など
5.その戦争によって、あらかじめめざす平和や国際関係のあり方を公示する。
6.手段選択の理由付けが明確である。

ロールズは、ヒロシマへの原爆投下は4と6の基準に照らして、「回避可能な悪」であったと、非難されるとする。

1995年とは、スミソニアン博物館へのエノラ・ゲイ(原爆投下に使われた戦闘機)の展示が物議を醸した年でもあった。スミソニアン博物館は、その展示を戦争展示ではなく、現代技術の推移を示すものとして現在も展示を続けている。

ロールズは「社会的有利性の配分の適切さが正義であり、そしてその配分の決定の手続きが公正である」という定義が気に入って、よくわたしも引用する。そして、1992年のOxfordの論文「万民の法」においては、平和共存の原理を次のように述べている。

1.その国が非拡張主義をとっていること
2.法治国家であること
3.基本的人権を守っていること

正義論において、ロールズは民主主義社会が正義にかなう政治体制であるとしている。それに対して、万民の法では、上記の三つがあれば、民主社会でなくとも、平和共存していけるのではないかとする。

この論文は時期的には万民の法の後ということになる。万民の法と正しい戦争のルールに照らせば、ほとんど、戦争はできないと言っているに等しい。

白熱教室の中の議論にも、これは戦争をしないという勇気ある宣言なのだ、という意見も出された。

川本さんは次のようにコメントははさんでいた。
「人権は大事だと言い続けること。戦争中だから、ということで捨ててはいけないもの。人権を尊重するということを社会の中で公示し、チェックすることが人権を守るためのひとつの手なのではないか。」
「戦争の不正義をあぶりだすために、「正しい戦争」という正義をたててみたのではないか。」
「戦争を悪をやっつけるために、正義のためにするのだと理屈づけられる。正義をどのように使うか。正義はひとつ限定したものではない。しかし、正義の原則をたてて、検討していくというのは、正しい、まっとうな社会の議論の仕方として有効なのではないか。」

ロールズの正義論を四苦八苦して読み通した時のことを思い出す。その時以来だ。わたしが参加型学習における「点検の視点」を重視するようになり、いくつかの原則を「点検の視点」として、参加型学習のアクティビティに取り入れるようになったのは。

もう一つの「理念を教育的ツールに」というのは、ベティ・リアダンさんからの学びであったが、点検の視点も、理念をツールにというのも、基本的には先人の到達点からすばやく学ぶ、討議のための土台にするという点では、共通している。

The COVEという映画をきっかけに、太地町では変化があった。その変化を鯨漁師を父に持つ14歳の中学生の眼から見たレポートを含む番組。
太地町は歴史的に捕鯨をしてきた町で、現在は沿岸小型捕鯨だけを行っている。現在、日本で沿岸捕鯨を続けている場所は25カ所。ツチクジラやゴンドウクジラが主な対象である。
太地町の「いさな組合」に所属する漁船は12隻、23名の組合員がいる。年間2000頭。1億円の売り上げ。鯨漁師たちの平均年収は350万円。町の平均年収250万円より多く、都会の平均年収に匹敵できるのは彼らだけだ。
2009年、The Coveを見た衝撃が走った。殺すシーンが、衝撃的な形で世界に流れたからだ。クジラ漁の実際を知らなかった14歳の少女も、ショックを受ける。と同時に、なぜこれほどまでにひどい言われ方をしなければならないのか、自分の父親のやっていることが不正義であるはずがないと、自ら捕鯨の歴史について学び始める。
捕鯨漁師たちは、すぐさま、影浦と呼ばれるクジラを殺す場所に天幕を張り、これ以上血みどろのシーンが国際的に流れることがないように、対策を始めた。
しかし、2010年9月から始まる漁期、シーシェパードら、海外の環境保護団体、動物愛護団体など4団体らは、常駐者を置くまでになる。彼らは殺戮の場面を撮影しようと、湾に近づこうとする。網を張り巡らして阻止しようとする漁師たち。網は何度も切られる。しかし、The Coveで、怒りを含んだ対応がむごたらしく編集され、自らのイメージを傷つけていることを学んだ漁師たちは、挑発には乗らない。車の前に立ちはだかれ、仕事を妨害され、自分たちの顔が容赦なく撮影されても、淡々と警察を呼び、対応を依頼する。逮捕するほどでもないと、警察も及び腰だ。
そのような体制で取り組んだにもかかわらず、今度はクジラを殺しているシーンが再び国際的に流れる。三好さんは、仲間に気を引き締めてくれと頼む。しかし、自分たちがやっていることが「悪」ではないならば、なぜ隠すのか。腑に落ちないままの仲間たちの気はのらない。そんなことをしていては、仕事にならないではないか。気にせず続ければいいのだと。
三好さんは、自分がクジラが死んでいく時のまなざしに罪悪感を感じて、一度はクジラ取りをやめたことを思い出す。あの罪悪感は何だったのだろうか。彼は三人の娘のため、家族のためにクジラ取りに戻り、後二年間は学費の援助が必要だ。
いまはやめられない。命をいただく仕事は他にもある。しかし、彼にとっては、クジラのまなざしがつらいのだ。写経によって心を鎮めるうちに、彼は、クジラの命の尊厳を大切にしたいと思っている自分の気持ちに気づく。仲間にも、死の際の尊厳を大切にしたいという気持ちを話す。
場面は太地町の祭り。クジラを食べる文化。コミュニティでの分かち合い。三好さんは組合から現物支給されるクジラ肉を30人以上の人々にお裾分けする。それは他のクジラとりも同様だ。1000人以上の人々が一度の捕鯨でおすそわけに預かることもあるほどだ。
中学生たちも議論する。結論は、外国からの圧力で、自分たちの文化を変えるのはいやだということ。少女は父の仕事を非難されるかという懸念が払拭され、ほっとする。彼女はオーストラリアに留学したときに、太地のことを理解してくれる人々に出会った。みんながみんな、捕鯨に反対ではなかった。
相互理解の道があるのかどうかはわからない。しかし、彼らは彼らの方法で、理解を求めていくしかない。

というような番組だった。
一般的な市場における鯨肉嗜好が軽減してきた今日、小規模小型沿岸捕鯨が認められるべきか否かは、資源量の確認にある。
しかし、インターネットで「ハナゴンドウの資源量」を検索すると、ミンククジラをとりたいのに、「細々と」小型鯨種をとっているという論調が眼につく。
いつまでたっても整理されていかないのが日本の捕鯨論争なのだ。
◎クジラ肉を食べる文化は、戦前には全国区ではなかった。
◎全国区に広がったのは食糧難の時代に、南氷洋捕鯨で獲得した肉を補給したからだ。
◎南氷洋の捕鯨は伝統捕鯨ではない。
これらの論点を整理することなく、商業捕鯨の南氷洋での再開を狙っているかのような論調がなくならない中で、沿岸小型捕鯨を論ずることはできない。
しかも、太地町は、南氷洋捕鯨に「鉄砲さん」を排出したという「栄光の記憶」を持つ町であり、南氷洋公開商業捕鯨と自分たちのクジラ文化を切り離して語ることのできない町だ。そのことが、問題をより複雑にしている。公海での捕鯨の歴史は資源管理の失敗の歴史であり、市場圧力のかかった欲の歴史である。
そこから何を学んだかを示さずに、これからの議論はない。
Since the winning of Academy Award of “The Cove” in 2009, there has been some changes in the Town of Taiji, a historical whaling town in Wakayama Prefecture. The program includes a report of such a change from the eyes of a teenager, 14 year-old middle school student, whose father is a whaler.
The whaling in Taiji is a coastal whaling, targeting small scale whale, within 200 EEZ. There are 25 fishing towns which continue small scale whaling in Japan. They catch mostly Bottle-nose dolphin and Gondous.
Taiji’s whaling is done by a team of fishermen who belong to Isana Whaling Cooperative. “Isana” is an old name for whale, now called kujira, in Japanese. There are 12 boats, 23 members in the cooperative. They catch 2,000 whales annually and the income is 100 million yen, which covers 30% of the Town’s revenue income. Each member’s annual income is 3.5 million yen, which is higher than the average of 2.5 million yen of Taiji Town, and compares fairly with that of big cities.
When they saw the Cove, they were shocked with the fact that the killing was shown bloody and brutally and being called slaughter, killer and such names and was shown worldwide. The 14-year-old girl, first seen the reality of whaling, shocked also, but was trusting what her father does as his job should not be unjust, started to learn more about whaling and its history.
The whalers reacted soon to hide the scene of slaughtering from international eyes by shading the place with tents.
But from the start of 2010 whaling season, which is from September, 4 groups of environmental protection and animal rights, including Sea Shepherd, stationed staff to film the slaughtering scene. The whalers put nets all around the bay, which were cut down time and again. Remembering that their reaction to the photographer, annoyed and angry, being edited as if merciless killers of wild animal just for the sake of life, the whalers were determined that they should show no temper against any action by Sea Shepherd and other groups. The harassments go as far as standing in front of a truck, shooting closely without the person’s permission, cutting nets, call names and so forth. Even to such acts, the whalers calm themselves and call a police, who is also helpless.
With such a alert, the direct shooting of killing whales appears once again on the internet website of Sea Shepard. Mr. Miyoshi, who is for hiding the scene, begs his fellows to pay more attention to hide, but there are who question why they should hide what they do as their way of earning. Why should they hide ass if they were doing something wrong?
Mr. Miyoshi once quitted the job as whaler when he could not stand the dying sad eyes of whales, returned because of his three daughters, to give them support for higher education. Recalling the guiltiness, he realizes that he observes the death of a whale as sacred, which should not be insulted by public view. He tells his finding to the fellow and some of them understood him, and why he wants to hide the scene.
The program covers the scene of festivals of Taiji Shrine. Whale meat consumption in their daily lives. Sharing of what caught.
Junior high school students discuss that they should not give up their culture to the pressure from abroad. The girl felt relieved that her classmates did not blame her father’s deed. She has been to Australia as exchange students and found out that not all foreigners are against whaling and seen whaling as brutal. The way to mutual understanding is not known, but they would try their way.
That’s what the program covered.
Today, general market pressure for whale meat is lessening, whether small scale coastal whaling can be accepted or not should be debated by the resource size. But if you check the internet for the data of stock for Gondous, you will read such sentences as “mink whales stock are robust, but since the ban of coastal whaling, they are catching “poorly” the Gondous and other small whales.”
It has been a long time but this debate leads to nowhere.

=At the time of lack of foods after the war, the abandon sum of whale meats were provided as the result of whaling race in Antarctica.
=Whaling in Antarctic Ocean is not traditional.
Without recognizing these, if there is a pressure for reopening the commercial whaling in the Antarctica, we cannot even debate the coastal whaling. Taiji is, furthermore, the town which remembers the “glory of Antarctica Whaling”, with heroes of “Teppo-san”, the shooters on the catcher boats, intertwined with the stories of past coastal whaling heroes. They can never talk about whaling culture apart from Antarctica Whaling. And that makes the problem even more difficult to solve. The history of high sea whaling is a story of a resource-management failure and market-pressure driven greed. Unless people shows what they have learned from these history, the common grounds for discussion will never be opened.
