第二 鉱毒問題第一期

 足尾銅山から流れた毒がどのような結果をまねいたかは、本当に明らかである。しかし、下流地域の沿岸田園に、その用水を通じて鉱毒被害が起こることは、すぐに農民を驚かすほどのことにはならない。それに対してすぐさま影響が出たのは、川岸の漁民であった。渡良瀬川名物の鮎はその姿も見られなくなり、鮭も遡上して来ても卵を生まず、その他の魚も死んでしまうことが多くなった。そのために、明治14年、時の栃木県知事藤川為親氏は、渡良瀬川流域の魚類の販売だけでなく、食用にすることも禁じたのである。
魚族が絶滅し、その結果沿岸の漁師、農民も、いずれ離散零落する結果になるという悲運が始まったのだ。
明治21年に起こった大洪水は、渡良瀬川、利根川沿岸一帯を泥土の海にしてしまい、同時に鉱毒で田園を覆い尽くしたのである。その結果、翌年、明治22年には、栃木県下足利、安蘇、梁田、下都賀の四つの郡は、鉱毒のために大変な不作に陥った。渡良瀬、利根の沿岸一帯は、鉱毒に犯されたのである。鉱毒は、両岸に広がる大小の堰樋を通じて、田園に流れ込み、用水に入り込み、作物を枯らし、人畜を倒したのだ。沿岸、およそ5万町歩、住民30万人である。一年一年と、鉱毒は激甚化し、祖先から伝わる田園は荒れ果て、五穀は実らず、家畜は死に絶え、人は病みついて倒れてしまった、その数も知れないほどだ。哀れなのは、これらの罪なき人々が、人災によって着るものもなく、食べ物もないというような窮状に陥った。死んだ子を背負い、病気の親をかかえ、茫然自失と茅すすきが生い茂る間をさまよい歩いている。光かすかな落日を拝みながら、行政の冷酷さと世間の無情を大声で嘆いているのである。
翌年、明治23年の栃木県知事折田平内は、鉱毒試験田を、下都賀郡谷中村、安蘇郡植野村、足利郡吾妻村、毛野村、梁田郡山辺村、区の村などに設置し、技師を派遣して土壌分析試験を行わせた。正確な結果を出すことができず、さらに農科大学に依頼するようにもなった。

Chapter Two: Pollution from the Mine, First Period
It is very clear what the pollution from the Asio Copper Mine had caused. But, you have to know that it was sometime later the farmers realized the harm the polluted water done to the land. More immediate effects were felt by the fishermen of the fresh water. The famous sweetfish, Ayu, of Watarase River, was gone, salmon stopped spawning, and other fish died out. Tamechika Fujikawa, the Governor of Tochigi Prefecture at the time, ordered sales and eating of fish from Watarase River in Meiji 14, 1881.
It was the beginning of extinction of fish, leading to the tragedy of fishermen and farmers, from losing their livelihood.
The great flooding in Meiji 21, 1888, covered Watarase, Tone Rivers’ beds and estuaries, which brought pollutions from the mine. As the result, next year, Meiji 22, saw a very poor harvest because of the damage, in Simoasikaga, Aso, Yanada, Shimotuga Counties. Watarase and Tone Rivers estuaries were polluted. The pollution dispersed through canals and weirs into the patty fields, flow into banks, thereby damaged crops and killed human and live stocks. It affected 50,000 ha and 300 thousands people. Year by year, the pollution accumulated and the damage escalated to the extent that the farmers lost the field, crops, cattle and even their health, which all they inherited from their ancestors. They held their dead children, with their old parents sickened, just wondered in the marshland which was once a very fertile land. They are crying for the cruelty of the Government and the carelessness of the general public.
Next year, in Meiji 23, Orita Heinai, the Governor of Tochigi Pref., opened some testing grounds for pollution in Yanakamura, Uenomura, Azumamura, Kenomura, Yamanobemura and other places and positioned technical officers for soil analysis. But, since they could not come out with acculate figures, he also asked Agricultural Collage for further investigation.

当時は、被害民はどこまでもがまんしていた。しかも、明治23年8月および翌年9月にも大洪水があって、毒土が田園にうずたかく積もり、作物が枯れ、人も家畜も病に倒れてしまったのです。そういうことが度々起こった結果、とうとう我慢も限界になり、明治24年12月、栃木県安蘇郡植野村、犬伏町、界村、足利郡吾妻村、久野村、(以下、群馬県、茨城県、埼玉県、千葉県にまでわたる78ヵ村の連名が記されている。略)・・・・・被害民一同が連署して請願書を政府に提出し、救済を訴えた。請願書に書かれていたのは「鉱毒を除外する道を講じること、それができないのであれば、鉱山業を停止させること」であった。これと同時に、代議士である田中正造氏が第二議会において鉱毒問題を声高に叫び、「足尾銅山鉱毒加害の儀に付質問書」を提出した。
1. 政府が何年もの間、対策を怠って来たのはなぜか。
2. すでに起こっている損害に対する救済策はどうするのか。
3. 将来起こりえる損害を防止する手だては何か。
以上の三点について、政府の答弁を求めた。これが鉱毒問題が社会全体の問題とされた最初である。
にもかかわらず、第二期の議会は、12月29日には解散し、当時の農商務大臣睦奥宗光はその間何もしないまま、議会が解散した後になってはじめて、答弁書を公開した。答弁の要点は以下の通りである。
1. 群馬、栃木、両県における渡良瀬川沿岸の耕地に被害が出ているのは事実であるが、その被害の原因がはっきりしていない。
2. 被害の原因について、現在のところ専門家が試験調査をしているところである。
3. 鋼業者側は、できる限りの予防策は行っており、ドイツやアメリカから粉鉱採集器を購入して、流出防止に務めている。

この答弁書の第三項を読んだだけでも、被害の原因が鉱山にないなどとは言えないことは明らかである。であるのに、原因が不明であるとか、専門家が調査しているところだなどと言うのは、質問の矛先をかわすためでしかないことははっきりしている。

The victims of pollution were first endured the damages. To add to the damage, there were big flood in August , Meiji 23 and September, Meiji24, which carried polluted soil and piled up onto the fields and killed crops, people and animals. Damage after damage, people no more could endure the results so submitted petition to the government. The petition demanded that the government should take measures to eliminate the pollution and if this is not possible, the government should close the mining.”
At the same time, PM Tanaka Shozo raised questions on the pollution from the mine at the Second Diet and submitted “Questions regarding the Asio Copper Mine Pollution”.
1. Why the Government has been inactive to prevent pollution?
2. What are the measures the Government takes to rescue the damage already done?
3. What are the measures to prevent further damages might be caused in the future?
PM Tanaka asked these questions and asked the Government to answer in the Diet. This is the first of the Asio Pollution Issue to become public.
However the Diet closed on December 29th and the Minister of Agriculture and Industry Mutsu Munemitu at that time, did not react within the session, but answered only after it closed. The answer was as follows:
1. Gumma and Tochigi, both prefectures’ patty fields in the estuary of Watarase had been damaged, but it is not still clear what cased these damage.
2. The Government has asked professionals to search and test the cause.
3. The miner is taking measures to prevent the runoff, using special equipment imported from Germany and US.

You’d know that the Government recognizes the cause is from the mining, if only you’d read the close No.3. Nevertheless, it is obvious that the Government is trying to gain time to dodge the claim.

読者の方々よ。考えてみてほしい。この答弁書は、提出されないまま議会は早々に解散させられたのです。つまり、農商大臣睦奥宗光は、この責任を逃れようとして、議会の解散時期に合わせて答弁書を作成したのではないかと、誰しも思うのではないだろうか。また、読者の方々は、睦奥宗光の二人目の子どもが、この問題の直接の責任者であり、古河市兵衛の養子であるというような姻戚関係にあることを書いておかざるを得ない。当時被害民たちは次のように叫んだものだ。「陸奥は親戚筋にあたる古河の利権を守るために、態度をあいまいにして責任逃れをしたのだ」と。わたしは、すでに亡くなられている陸奥氏に対して当時の心情を勝手に忖度しようとは思っていない。しかし、いまにして思えば、「政府資本家が共謀結託して、谷中村を滅亡させた組織的な犯罪は、ここから始まったのだ」と、わたしもまた、不幸なことではあるが、宣言せざるをえないのだ。

Reasers! Just think! This answer was not submitted before the session of the Diet resolved. Anybody would think that the Minister of Agriculture and Trade, Mutu Munemitu, waited until the Diet is over to present the answer so that he could avoid further debate and responsibility. Another fact is that the second child of Mutu is adapted by Furukawa Ichibee as his successor and he is the one who is in charge of this problem. At that time, the victims cried loud that Mutu is trying to protect the benefit of Furukawa and at the same time to avoid his own responsibility. I do not intend to guess what the Minister Mutu was thinking, who is already dead, but only dared to declare that the conspiracy by the Government and the industry together had started at this time, to the unhappiness of the victims.

第三 鉱毒問題第二期
第二議会を解散した、明治25年の春に総選挙が行われたが、政府が干渉する中、流血殺傷騒ぎとなった。第三会議はそのような官民が反目しあう中で召集された。政府の激しい干渉に打ち勝って再選を果たした田中正造氏は、過日の陸奥農相の答弁書をとりあげて、鉱毒問題について質した。憤りはげしく、血の汗をながさんばかり、目に強い光をやどして質問した。これによって、試験調査を行った専門家たちの報告書が公開されることになった。
大学教授の丹波敬三氏の報告書にはこのように書かれている。「・・・田圃被害の要因は、土中にある毒にある。その毒は足尾銅山からだと言っていいだろう。・・・」
また、農科大学の報告書ではこうある。「・・・渡良瀬川の河底に沈殿している汚泥には植物に有害な物質が含まれており、被害地に有害物が広がっている理由は、洪水氾濫の時、田圃に汚泥が流れ込み、沈殿したことは明らかである。足尾銅山鉱業所から渡良瀬川に入る排出水に有害物が含まれていることも事実である。」と。

Chapter 3 Copper Pollution Period 2
After the resolution of the Second Term of the Diet, General election was held in Meiji 25, 1892. The Government intervened with the process and there were incidents which developed into injuries and killings. The Third Term of the Diet started in the conflict between the Government and the people. PM Tanaka made a come-back to the Diet, even with harsh disturbance from the Government and brought to question the Answer by the Minister of Agriculture, Mutsu. He was furious in his accusation with his strong will in his eyes. This led to open the research results by the experts to the public.
Tamba Keizou, a university professor, wrote in his report, “the damage done to the patty fields was caused by the poison in the soil. I could say that the poison came from Asio Mine.”
Another report from an agricultureal college said, “… the silt down at the bottom of the Watarase River contained poisonous substance to the plants and the reason why this poison spread in the damaged area is that they were carried by the flood water into the patty fields and sank. It is the fact that the waste water from the Asio Mine flows into the Watarase River contained the poisonous substance.”

田中代議士が第二議会で行った第一回の質問に対して、当時の政府が答弁した内容は、渡良瀬沿岸の耕地に広がる被害は、まだ原因がはっきりせず、原因について調査中であるということだった。その調査がすでに完了し、被害の原因が足尾銅山が流れる毒にあることが、だんだんとはっきりしてきたからには、政府の当然の義務として、善後策を講じる必要がある。例えば鋼業条例を見てみよう。第59条はこう言っている。「鉱業を行う上で、危険がある、あるいは公益を害すると認められるときは、所管監督署署長は、鉱業主に対してその予防を命じるか、あるいは停止しなければならない。」だとすれば、この時政府が執るべき方法は、直ちに鉱業の停止を命じるか、あるいは周到な予防策をとるように命令するかの二者択一でしかなかった。
にもかかわらず、政府はこれらの手だてを執らず、言を左右ににごして責任逃れをしようとした。当時は、陸奥農相はすでに役をしりぞき、河野敏鎌が農相になっていた。河野の答弁書は以下の通りである。
1. 足尾の鉱毒が渡良瀬河岸一帯の被害の一つの原因であることは試験調査の結果によって認められたと言えるが、この被害が公共の安寧を揺るがすほどのものであるとは言えない。
2. 既往の損害は、行政官にはなんらかの対応をする職権がない。
3. 将来の予防のために、鉱業主は粉鉱採取器を設置する準備をしている。
4. 鉱業主は、上野国待・矢場の両堰水利土功会と契約をかわして、自費で両堰の水門内に沈殿場を設置し、定期的に浚渫する準備をすすめている。

To the question PM Tanaka raised first at the sedonc term of the Doet, the Government answered that the cause of the damage spread at the estuary of Watarase is not still clear and researches are on going. Since the reports from the researches were open, it is the responsibility of the Government to take some measures to solve the problems. For example, let’s look at the Act on Mining, Close 59. It says “when running the mine, if there is the danger or a threat to the public welfare, the head of the office in charge whould order the owner of the mine to take preventive measures or to stop the operation.” If so, at this time, what the Government should choose from was either order to stop the operation at once or take effective preventive measures.
However, the Government tried to escape its responsibility. At that time the Minister Mutsu had already retired and Mr. Toshikama Kouno was in the position. His answer was as follows:
1. It can be conclude that the pollution from the Asio Mine is one of the cause of the damage done to the estuary of Watarase, but the damage cannot be said as such to threaten the public welfare.
2. There is no power given to the office in charge to do with the damages already done.
3. For the future, the owner of the mine is preparing slug recovery equipment installed.
4. The owner of the mine is going to set a contract with the Water Use Union of Machi and Yaba of Kouzuke Country to build sedimentation basins within the bank and periodically dredge them.
